TERMS OF USE

Welcome to the website network.bahco.com (the “Website”), which allows members of the Bahco Network to interact with developers and management for Bahco® products, services, activities, news and events. By joining the Bahco Network and using the Website, you acknowledge that you have read, understood and accepted these terms of use (“the Terms of Use”) without reserve. If you do not accept these Terms of Use, please refrain from using the Website. For the purpose of this document, “SNA EUROPE” refers to the publisher of the Website, as presented in our Legal Notice accessible here.

1. Use of the Website

You may access and browse the Website solely in accordance with these Terms of Use and the applicable laws. In particular, you will not:

  • reproduce or circumvent in any way the navigational structure or presentation of the Website in order to obtain any material, document or information through any means that are not purposely made available through the Website;

  • use any software, routine or device in order to hinder the proper operation of the Website;

  • take any activity in order to gain unauthorized access to any portion of the Website;

  • take any activity which imposes unreasonable or disproportionately large load or traffic on the Website or associated infrastructure.

2. Joining and leaving the Bahco Network

Any professional who use hand tools as part of their daily work is free to apply for membership in the Bahco Network. Nevertheless, we reserve the right to deny you such membership, without any justification, within 30 working days from your registration.

Membership is not open to employees of SNA EUROPE.

You may terminate your membership at any time, with 10 working days notice via e-mail sent to network@bahco.com,

SNA EUROPE may in turn terminate your membership for fraudulent use or behavior, or breach of these Terms of Use, the Privacy Policy or survey rules.

Termination will result in the immediate forfeiture of all rewards or points that have been accrued in relation with such use, behavior or breach.

The use of the members account by an individual other than the member will be considered a fraudulent use and will be ground for immediate termination and forfeiture of points.

SNA EUROPE reserves the right to delete inactive members from the Bahco Network. This means terminating the membership, if the member has not logged in on the website or does not respond to any invitation, by clicking any survey invitation link, for more than 2 years.

SNA EUROPE will inform you of such deletion and you will have 30 calendar days to log in to stay active, otherwise your membership will be terminated and the respective points account will be forfeited.

3. Taking part in the activities

Members can log in to the Website and participate in the activities, such as surveys or contests, posted there (the “activity(ies)”). There is no obligation to participate in any of the activities. Each activity is only to be completed once. The activities often have a target demographic (profession, country of residence, etc.) which will be clearly stated in the header. Rewards may only be given to those who complete the activity AND belong to the stated target group. Members may receive e-mails letting them know there is a new relevant activity on the Website. Please do not mark e-mails from SNA EUROPE .com or Bahco.com as spam. SNA EUROPE is not bound to send e-mails nor post activities at any given frequency. SNA EUROPE cannot guarantee a minimum number of activities per year.

4. Rewards for activities you complete

Each time you complete a correct survey before the assigned deadline, you will either receive points or another reward upon completion, or will be entered into a prize draw. The type and size of the reward or of the prize draw may vary per the survey difficulty, length or other similar elements.

There may be instances when the points for recently completed surveys do not immediately appear in your account. In such cases the points will be added later to your account.

When the necessary number of members has answered a survey SNA EUROPE have the right to end the survey at any stage and not collect further answers.

If you request to be unsubscribed from the Bahco Network, you will forfeit any points collected and your points account will be automatically deleted.

5. Confidentiality notice

As a member of the Bahco Network, you may be asked to review new concepts, products and packaging that are still in development and as such not known to the public. You may come in contact with, be allowed to see, use or otherwise have access to certain non-public, confidential, proprietary, or trade secret information or material that are the sole and exclusive property of SNA EUROPE. Any “Confidential Information” will be labeled as such and you must not copy, print, store, forward or disclose to anyone by any means, the Confidential Information you will have access to, and must not use the Confidential Information.

Information not labeled as confidential is still covered as Intellectual Property, as per section 6 below.

6. Intellectual Property

The Website, as well as all intellectual property rights in relation to its content (surveys, texts, images, videos, databases, sounds, photographs, know-how, products and products names, business names, logos, trademarks, etc.) are either the property of SNA EUROPE and/or its affiliates, or are subject to licenses and/or authorizations granted to us by third parties.

You are only authorized to use the Website and its content to the extent necessary to its online consultation in accordance with the Terms of Use. In consequence, you may not reproduce, make available to the public, perform, publish or modify any part of the Website and its content without prior agreement from SNA EUROPE.

In case you provide information and/or content to SNA EUROPE through the Website, you grant SNA EUROPE a non-exclusive, non-transferable, worldwide license to make use of such, for the entire duration of the related intellectual property right.

7. Personal Data

The conditions under which we may process personal data collected through this Website are explained in our “Privacy Policy” accessible here. You are also invited to refer to our Cookie Policy accessible here.

8. Hypertext links

The Website may include hypertext links to other websites which are subject to their own terms of use and privacy policy. SNA EUROPE makes no representation or warranty as to these other websites, their content and their use of your personal data. In consequence, SNA EUROPE shall not be liable for any damage resulting from your access, browsing or use of those other websites.

9. Disclaimer

The Website is provided to you “as is” and “as available” without warranty of any kind from SNA EUROPE. SNA EUROPE specifically disclaims all warranty that the information available on the Website is free from inaccuracies or omissions. Furthermore, SNA EUROPE does not warrant that the Website or the servers ensuring access to it will operate without interruption.

Accordingly, SNA EUROPE shall not be liable for any direct or indirect damage resulting from, notably and without limitation:

  • accessing, browsing or using the Website, which includes loss of data, destruction and computer viruses;

  • any fraudulent intrusion to or use of the Website by a third party.

SNA EUROPE may improve or change the Website and its content at any time and without notice.

SNA EUROPE may make substantial or non-substantial modifications to these Terms of Use at any time. Please, review this page periodically.

11. Applicable law and jurisdiction

These terms and conditions are subject to French laws. Unless such provision is deemed unenforceable by mandatory local law, any disagreement or litigation shall be dealt with by the competent French courts.
